Terms of Service

These Terms govern access to FlagWire’s hosted feature-management service, dashboard, APIs, documentation, and related support (the “Service”). By accepting these Terms or using the Service for an organization, you confirm that you can bind yourself and that organization to this agreement.

You must provide accurate account information, protect credentials and SDK keys, and promptly revoke access that should no longer be trusted. Organization owners and administrators control membership and production changes. You are responsible for actions taken through your accounts and keys, except to the extent caused by FlagWire’s breach of this agreement.

You may not share an account in a way that defeats identity, authorization, or audit controls. You must be at least 18 years old and legally able to enter this agreement.

You may use the Service to manage configuration and feature delivery for applications you are authorized to operate. Use must comply with the Acceptable Use Policy. Browser-delivered configuration is visible to end users and must never contain passwords, private keys, access tokens, or other secrets.

You retain ownership of customer configuration and data you submit. You grant FlagWire the limited rights necessary to host, process, transmit, secure, and support that data to provide the Service.

FlagWire retains ownership of the hosted Service, branding, and non-public management-plane software. Public SDKs remain governed by the license in their source repository.

Plan prices, allowances, and billable-unit definitions are stated on the Pricing page. Listed prices exclude applicable indirect tax. Dodo Payments acts as merchant of record for paid transactions and calculates applicable tax at checkout.

Subscriptions renew automatically for the selected interval until canceled. Upgrades may be prorated immediately. Downgrades and cancellations take effect at the end of the current paid period unless law requires otherwise. There are no automatic usage-overage invoices at launch.

Refund, dispute, and cancellation handling follows the Refund and cancellation policy.

FlagWire aims to provide a reliable Service and publishes operational status when appropriate, but does not offer a contractual uptime or response-time SLA unless a separate signed agreement says otherwise. Maintenance, security response, upstream provider failures, and events outside reasonable control may affect availability.

We may change the Service to improve security, reliability, or functionality. We will not intentionally make a material paid-plan reduction effective during an already-paid term without reasonable notice or a legally required remedy.

We may restrict or suspend access when reasonably necessary to prevent fraud, compromised credentials, denial-of-wallet attacks, illegal activity, material security risk, or material breach. Where practical, we will limit the restriction and provide notice. Ordinary paid quota consumption does not suspend runtime evaluation.

You may stop using the Service and cancel a paid subscription. Export configuration before deleting a project or organization. Deletion is irreversible once confirmed. Some transaction, security, and legal records may be retained where required by law or legitimate fraud-prevention needs.

Each party will use reasonable care to protect non-public information received from the other and will use it only for this agreement. This does not cover information that is public without breach, already known without restriction, independently developed, or lawfully received from another source.

Our current security practices are described on the Security page. You remain responsible for secure application defaults, appropriate targeting data, and deciding whether the Service is suitable for your use case.

The Service is provided on an “as available” basis. To the maximum extent permitted by law, FlagWire disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes rights or liability that cannot legally be excluded.

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, revenue, goodwill, or data. FlagWire’s aggregate liability arising from the Service is limited to the fees you paid for the Service during the 12 months before the event giving rise to the claim. This limit does not apply where prohibited by law.

These Terms and the referenced policies form the agreement for the Service unless a separate signed agreement applies. If part of the agreement is unenforceable, the remainder continues. A failure to enforce a provision is not a waiver. You may not transfer the agreement without consent, except with a merger or sale of substantially all relevant assets. FlagWire may transfer it as part of a business reorganization or sale.

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts with jurisdiction in Jammu, Jammu and Kashmir, India have exclusive jurisdiction, except where mandatory consumer law requires otherwise.
